Terms of Use

These Terms of Use govern your use of the Skyfy advertising service and the Skyfy Bazaar, through which we create and publish Instagram and Facebook ads on your behalf. By creating an ad you accept these Terms.
1. Provider and scope
The service is operated by Skyfy GmbH, Auhofstraße 9a, 63741 Aschaffenburg (registered address), Germany, represented by Ayhan Bulut. These Terms apply to every advertiser who submits an ad through our website. Deviating conditions of the advertiser do not apply unless we agree to them in writing.
2. What we do
We publish your ad on Instagram and Facebook through our own Meta advertising accounts. You do not need your own Meta account or credit card. In addition, we provide a free business page for you (skyfy.me/b/…) that lists your own contact channels. Every ad is shown as coming from Skyfy; the advertised content is yours.
3. Creating an ad and conclusion of contract
Creating and submitting an ad is free and non-binding. After a short review you receive payment instructions. A binding contract for publishing your ad is concluded once you pay and the payment reaches us. Until then you owe nothing and can withdraw at any time.
4. Prices and payment
You set your own budget, starting from 50 USD. Of the amount paid, 80% is used as your actual ad budget and 20% is our service fee (setup, publishing, monitoring, results report). Payment is currently possible via Sham Cash or bank transfer. All amounts are shown transparently before you pay.
5. Your content and your obligations
You are responsible for the content you submit (text, images, videos, offers, links). You confirm that you hold the necessary rights to this content and that it does not infringe any third-party rights or applicable law. Prohibited are in particular misleading, illegal, offensive, or rights-infringing content, as well as content that violates the advertising policies of Meta.
6. Review, publication and no guarantee of reach
We check every ad for publishability before payment and may ask you to make changes. Publication ultimately depends on the approval of the ad platforms (Meta). We cannot guarantee a specific reach, number of clicks, or business result, as these depend on many factors outside our control.
7. Refunds
If your ad cannot be published after payment and we cannot adjust it with you so that it runs, you receive a refund of the corresponding amount. Amounts already spent on ads that were actually delivered are not refundable.
8. Liability
We are liable without limitation for intent and gross negligence. For slight negligence we are liable only for a breach of essential contractual obligations and limited to the foreseeable, typical damage. We are not liable for the availability of third-party platforms (Instagram, Facebook, payment providers) or for the business success of your ad.
9. Changes to these Terms
We may amend these Terms where necessary, for example due to changes in the law or in our service. The version in force at the time you submit an ad applies to that ad.
